Assam CM Himanta Biswa Sarma has maintained silence on the SC's recent judgment upholding the validity of Section 6A of the Citizenship Act.

SC's majority verdict upholding Section 6A of The Citizenship Act has importance not just for Assam, where politics has long been shaped by issues of migration and demography, but also for wider issues of citizenship.

The Supreme Court has delivered a judgment on the issue of immigration in Assam. The petitioners challenged Section 6A, asserting it infringes upon key fundamental rights.

The Supreme Court upheld Section 6A of the Citizenship Act, validating the Assam Accord's 1971 cut-off date for citizenship determination. Despite opposition seeking a 1951 cut-off, the verdict acknowledged the Assam agitation's legitimacy.

Section 6A was introduced in 1985 as part of the Assam Accord, an agreement between the Indian government and leaders of the Assam movement.

Justices Surya Kant, M M Sundresh and Manoj Misra in their majority verdict held that Parliament had the legislative competence to enact the provision. Justice Pardiwala gave a dissenting judgment to hold Section 6A as unconstitutional.
